INSURANCE LAW IN ISLAM

The word Insurance is derived from English which is insurance which means a guarantee. Insurance is a collective insurance agreement between two people aka more, the one will get a certain payment in the event of a fire disaster, accident aka death. While the other parties (including those affected by the disaster pay dues that have been determined by the time and the amount.

In Indonesia, two kinds of insurance must be coordinated by the government for insurance for people who have motor vehicles, health insurance, and still not a few more. Then voluntary insurance is insurance established by an institution aka community group If life insurance, education insurance, property insurance, and so on.

Insurance Law From an Islamic Point of View

Reviewed from Islam insurance is classified from the struggle Together please help recommended by Islam as the word of Allah SWT listed in the letter Al-Maidah paragraph 2.

The first to say about insurance among Muslims was Muhammad ibn Amir ibn 'Umar, who was popular with Ibn Abidin Addimasyqi of the Hanafi sect, who died in 1252 Hijri aka the same as 1836 AD. This is already doubted in his book RADDULMUKHTAR SYARAH TANWIRUL ABSHAR, the book is known as HASYIYAH IBN ABIDIN. The problem is also revealed in his book entitled AJWIBAH MUHAQQAAQAH'AN AS ILAH MUTAFARRIQAH (the correct answer to various problems).

Ibn Abidin said: "If a trader rents a ship to load goods from abroad, then the cost of the ship has been paid, and pays a certain amount of finance to someone abroad to ensure the safety of the trader. So if the merchant drowns, the agreement must pay for the calamity. That is the ruling. The Muslim merchant can't get that sorry change for his perishable goods.

And when insurance services have entered Islamic countries, so the insurance has been viewed with a hesitant view. So few of them forbid it by ignorant arguments against sharia and deceit. Others say that it is the same as usury that is forbidden. Some call it gambling and do not believe in the destiny of Allah SWT.

But the view of other fiqh experts states that the legal insurance is Halal alias should not be Haram. Look at that factor in the bail system. So there are differences of opinion on both sides, in fact not least leaning on social insurance and help. And the chastity of his efforts is still required from usury.
